As long as we're talking Kelo, I just want to mention that although I agree with the conservatives who say Kelo was a bad decision, I'd feel a lot better about agreeing with them if even one of them was intellectually honest enough to acknowledge that what they wanted the Court to do with Kelo was what they usually deride as legislating from the bench. They wanted unelected judges to prevent local elected officials from making the decisions they think are best for their municipalities. When conservatives say they don't want judges who legislate from the bench, what they mean is that most of the time a judge legislates from the bench, he's doing something conservatives oppose. When judges who legislate from the bench are doing something conservatives support, they're all for it.
